Appoint a \'clean\' Chief Justice to Kerala HC: Iyer tells PM

Former Supreme Court judge Justice V R Krishna Iyer yesterday appealed to Prime Minister Manmohan Singh to ensure that the vacancy of Chief Justice of Kerala High Court is filled by a \"fine robed brother\" and \"never by one who is under a shadow\".



In a letter to Prime Minister Manmohan Singh, copies of which were released to the media, he also criticised the Collegium system of appointment of judges saying it was exercising the power of transfer of Chief Justices from other states to Kerala.



\"To my mind this is usurpation without authority but the Executive is not setting up a code of conduct by constitutional amendment against judicial delinquency,\" Justice Iyer said.



Justice Iyer said certain names as successor (to the present Chief Justice) are rumoured and there are also allegations against them.



\"We want a clean Chief Justice and never a suspect one.



As Prime Minister you have a paramount duty to the country to investigate into the character and social philosophy, the integrity and ability of any proposed chief justices. Already the judicature in India is on its dark days although there are good judges,\" Justice Iyer said.
